Kathleen Duckett McCann possesses the knowledge, expertise and enthusiasm to handle appeals effectively
Many lawyers will take a client’s case through trial, however, they do not wish to handle an appeal to the Court of Special Appeals or the Court of Appeals. Appeals are particularly work and time intensive and require strict adherence to the appellate rules of procedure. Appeals are based on the record created at the trial court level. The record consists of all of the papers filed in the trial court as well as the evidence admitted and the testimony taken at trial. No additional testimony or evidence is permitted in the appellate courts.
There is a heavy emphasis on the legal research, writing, and oral argument skills of an appellate attorney. Ms. McCann has excellent research, writing and oral argument skills required to pursue or defend against an appeal. Furthermore, she finds appellate work to be among the most satisfying and exciting form of legal work. She is happy to review a client’s case after trial in order to render an opinion regarding the potential merits of taking an appeal or defending against an appeal. If she feels the client has good grounds for an appeal, she is prepared to represent the client in the Courts of Appeal. She has the knowledge, experience and enthusiasm to handle appeals effectively.
